Terms of Service

mNeuroMap™ by PathoBrainSeq Inc. — Last Updated: April 25, 2026 | Effective Date: April 30, 2026 (Phase 1 Launch)

1. Acceptance of Terms

By downloading, installing, accessing, or using mNeuroMap™ (the "Service"), you agree to be bound by these Terms of Service ("ToS"). If you do not agree to these terms, do not use the Service.

These ToS constitute a binding agreement between you ("User") and PathoBrainSeq Inc. ("PathoBrainSeq", "we", "us", "our").

2. Wellness Monitoring — Not a Medical Device (FDA Disclaimer)

The Service does NOT:

• Diagnose Alzheimer's disease, Parkinson's disease, dementia, or any medical condition
• Treat, cure, or prevent any disease
• Provide medical advice, treatment recommendations, or prescriptions
• Replace consultation with licensed healthcare professionals

FDA Status: mNeuroMap™ is intended as a "general wellness product" under FDA guidance "General Wellness: Policy for Low Risk Devices" (2019). It is not subject to FDA premarket review.

You acknowledge that:

• Score patterns or trends shown in the Service are for personal awareness only
• Any concerns about cognitive health must be discussed with qualified medical professionals
• The Service should not delay seeking professional medical evaluation

3. Eligibility

You must be:

• 18 years or older
• Legally capable of entering into binding contracts in your jurisdiction
• Not prohibited from using the Service by applicable law

By using the Service, you represent and warrant that you meet these requirements.

4. Account Registration

4.1 Sign-In Methods

You may create an account using:

• Email and password
• Sign in with Google (Google OAuth)
• Sign in with Apple (Apple ID, conforming to Apple Review Guideline 4.8)
• Guest mode (limited features, no data persistence)

4.2 Account Security

• You are responsible for maintaining the confidentiality of your credentials
• You must notify us immediately at infor@pathobrainseq.com of any unauthorized access
• We reserve the right to suspend accounts showing suspicious activity

4.3 Sign in with Apple — Specific Terms

• When you use Sign in with Apple, Apple may share a private relay email instead of your real email
• We honor that relay address and will not attempt to discover your real email
• You may revoke Sign in with Apple consent through your Apple ID settings at any time
• Revocation will result in account inaccessibility unless you re-authenticate via another method

5. Service Availability — Phase 1 Free

If we introduce paid features in future phases, we will:

• Update these ToS with at least 30 days' advance notice
• Allow you to continue using existing free features
• Provide clear pricing disclosure before any charge

You will not be charged in Phase 1 under any circumstance.

6. Wait-list — Future Features (Early Access)

The Service offers a "Wait-list" feature where you may opt in to receive notifications about future product enhancements (e.g., advanced AI insights, biomarker integration).

6.1 Wait-List Data Collected

• Email address (required)
• Source (which app surface you joined from)
• Locale (language preference)
• Timestamp
• GDPR consent: required (separate checkbox)
• Marketing consent: optional (separate checkbox, may opt out anytime)

6.2 Wait-List Purpose

• Notify you when Early Access features become available
• Send up to 1 transactional email per month (max) until features launch
• We will NOT use wait-list data for unrelated marketing without your explicit consent

6.3 Wait-List Opt-Out

• Reply to any wait-list email with "UNSUBSCRIBE"
• Or contact infor@pathobrainseq.com for immediate removal

7. User Conduct

You agree NOT to:

• Use the Service for any unlawful purpose
• Submit false or misleading information
• Attempt to reverse-engineer, decompile, or extract source code
• Bypass authentication, rate limits, or security features
• Use automated scripts to interact with the Service (without prior written consent)
• Impersonate another person or entity
• Submit content that infringes intellectual property rights
• Submit content containing malware, viruses, or harmful code
• Use the Service for medical decision-making in lieu of professional advice

Violation may result in account suspension or termination.

8. Privacy and Data Protection

8.1 Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these ToS by reference.

8.2 Your Rights (GDPR / CCPA)

You have the right to:

• Access: Request a copy of your personal data (GDPR Art. 15)
• Rectification: Correct inaccurate data (GDPR Art. 16)
• Erasure ("Right to be Forgotten"): Request deletion (GDPR Art. 17)
• Portability: Receive your data in a machine-readable format (GDPR Art. 20)
• Object: Object to processing for marketing purposes (GDPR Art. 21)
• Restrict: Restrict processing in specific circumstances (GDPR Art. 18)
• Withdraw Consent: At any time without affecting prior lawful processing (GDPR Art. 7(3))

8.3 How to Exercise Your Rights — Single Channel (Apple Review 4.0 + GDPR Art. 12)

We will respond within:

• 30 days for GDPR data rights requests (Art. 12(3) compliance)
• 24 hours (business days) for general inquiries
• 5 minutes acknowledgment for urgent safety/security/legal escalations

The "Contact Support" button inside the app (Dashboard → Support) provides a one-tap link to this channel with diagnostic information automatically attached.

8.4 Data Deletion

• In-app: Profile → "Delete My Data" (immediate deletion of account + cognitive history)
• Email: Reply with "DELETE MY DATA" — processed within 30 days

9. Intellectual Property

9.1 Our IP

mNeuroMap™, NeuroMapDx™, cMindMap™, PBWA™, and all related logos, trademarks (USPTO Registered or Pending), copyrights, and intellectual property are owned by PathoBrainSeq Inc. or its licensors.

USPTO Provisional Patent (filed 2026-03-19, Micro Entity) covers the underlying multi-omics method and AI biomarker integration claims.

9.2 Your Content

• You retain ownership of any content you submit (e.g., self-check responses)
• You grant us a worldwide, non-exclusive, royalty-free license to use your content solely to provide and improve the Service
• We will NOT sell or license your content to third parties without your explicit consent
• Anonymized aggregate data (with consent) may be used for research per our Privacy Policy

10. AI-Assisted Customer Service Disclosure

You are notified when an AI Assistant generates a response (subject line and message footer indicate "AI Assistant").

For sensitive matters (medical concerns, legal threats, security incidents), responses are reviewed and sent by human team members, not AI.

You may always request human review by replying with "HUMAN REVIEW REQUESTED" to any AI-generated message.

11. Disclaimers

We disclaim all warranties including:

• Merchantability, fitness for a particular purpose, non-infringement
• Accuracy, reliability, completeness of any cognitive score or pattern
• Uninterrupted, secure, or error-free operation
• That defects will be corrected

Specifically, we do NOT warrant that any cognitive wellness pattern, score, or trend has medical predictive value. Any decision based on the Service is at your own risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATHOBRAINSEQ INC. SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Any damages exceeding USD $100 in aggregate per user

This limitation applies even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability — in such jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless PathoBrainSeq Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these ToS
• Your violation of any third-party rights
• Any medical decision you made based on Service output (which we explicitly do not recommend)

14. Modification of Terms

We may modify these ToS at any time. Material changes will be:

• Posted at pathobrainseq.com/mnm-terms-of-service.html
• Notified via email at least 30 days before taking effect
• Highlighted in-app on next sign-in

Continued use after the effective date constitutes acceptance. If you disagree, discontinue use.

15. Termination

15.1 By You

You may terminate your account at any time via Profile → "Delete My Data".

15.2 By Us

We may suspend or terminate your account if you:

• Violate these ToS
• Engage in fraudulent or abusive behavior
• Pose a security risk to other users or our systems
• Are required to be terminated by law enforcement

Upon termination, your data will be deleted per our Privacy Policy retention schedule.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These ToS are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

16.2 Arbitration (US users)

Disputes will be resolved through binding individual arbitration under the rules of the American Arbitration Association (AAA), held in San Jose, California.

16.3 Class Action Waiver

You waive the right to participate in class actions or class arbitrations to the extent permitted by law.

16.4 EU/UK Users

EU/UK consumers retain rights under their local consumer protection laws. Disputes may be brought in your country of residence courts as required by law.

16.5 Korean Users

Korean users retain rights under the Personal Information Protection Act (PIPA) and Consumer Protection Act. Disputes may be filed with the Korea Consumer Agency or local courts.

17. Apple-Specific Terms (App Store Distribution)

If you access the Service via the Apple App Store, you acknowledge:

• These ToS are between you and PathoBrainSeq Inc., not with Apple
• Apple is not responsible for the Service or its content
• In case of failure to conform to warranty, you may notify Apple, and Apple will refund the purchase price (if any) — note: Phase 1 is free, so no refund applies
• Apple is a third-party beneficiary of these ToS and may enforce them against you
• Maintenance and support for the Service is provided solely by PathoBrainSeq Inc.

18. Severability

If any provision of these ToS is found unenforceable, the remaining provisions remain in full effect. The unenforceable provision will be replaced with an enforceable provision matching the original intent as closely as possible.

19. Entire Agreement

These ToS, together with our Privacy Policy and any other notices we provide, constitute the entire agreement between you and PathoBrainSeq Inc. regarding the Service. They supersede any prior agreements.
